Acknowledgment of Service Terms and Liability Waiver
I, the undersigned, hereby acknowledge that I am engaging A Bark Away NJ for dog training, pet sitting, and pet walking services for my beloved pet.

I understand and willingly agree to the following terms:

Awareness of Risks:
I acknowledge the inherent risks associated with dog training, pet sitting, and pet walking services. These risks may include, but are not limited to, injuries to pets, property damage, or unforeseen incidents. While every precaution is taken by A Bark Away NJ, I voluntarily assume these risks and absolve A Bark Away NJ of any liability for resulting loss, damage, injury, or expense, except in cases of gross negligence or willful misconduct.

Veterinary Care Responsibility:
I understand that A Bark Away NJ is not liable for any veterinary expenses incurred during or as a result of the provided services. I agree to maintain adequate pet insurance to cover such expenses and hereby release A Bark Away NJ from any related liability.

Emergency Authorization:
I authorize A Bark Away NJ to seek emergency veterinary care for my pet in the event of a medical emergency if deemed necessary. Although every effort will be made to contact me or my designated emergency contact beforehand, I agree to reimburse A Bark Away NJ for any veterinary expenses incurred on behalf of my pet.

Liability Release:
I hereby release, discharge, and indemnify A Bark Away NJ, its owners, employees, contractors, and agents from all liability, claims, demands, actions, or causes of action arising from the provision of dog training, pet sitting, or pet walking services. This includes, but is not limited to, bodily injury, property damage, or other losses, except in cases of gross negligence or willful misconduct.

Indemnification:
I agree to indemnify and hold harmless A Bark Away NJ, its owners, employees, contractors, and agents from any claims, damages, losses, or expenses, including attorney fees, related to my use of the services, my pet's behavior, or any breach of this agreement.

Owner Liability for Dog's Behavior:
I understand that I am liable for my dog’s behavior and any consequences thereof. This includes, but is not limited to:

Injuries to Other Animals: If my dog harms another animal during a training session, walk, or while being cared for by A Bark Away NJ.
Injuries to People: If my dog bites or injures a person, whether it is an A Bark Away NJ staff member, a bystander, or another client.
Property Damage: If my dog damages property, whether it is at my home, an A Bark Away NJ facility, or any other location where services are being provided.
Behavioral Issues: If my dog exhibits aggressive or uncontrollable behavior that results in any type of harm or disruption.

Vaccinations & Documentation:
I confirm that my dog is current on all vaccinations as required by A Bark Away NJ, including but not limited to Bordetella, rabies, and distemper. I understand that I must submit acceptable documentation confirming these vaccinations. A Bark Away NJ reserves the right to waive the Bordetella vaccination requirement upon my execution of a waiver.

Flea & Tick Preventative:
I confirm that my dog is free of fleas, ticks, worms, and other parasites, and that my dog is on a flea and tick preventative. A Bark Away NJ reserves the right to reschedule training if it determines, at its sole discretion, that my dog is not free of fleas, ticks, worms, or other parasites.

Use of Training Tools:
I acknowledge and understand that A Bark Away NJ may use training tools and techniques, including but not limited to muzzles, slip collars, prong collars, and e-collars, to train and modify my dog's behavior. These tools are like insurance for you and your dog, ensuring clear communication and keeping your furry friend safe. I consent to the use of these tools as deemed necessary by A Bark Away NJ.

Limit of Liability:
The maximum liability of A Bark Away NJ shall not exceed the lesser of the current market value of a dog of similar breed or the sum of $200.00, whichever is lower.

Media and Publicity Release:
I acknowledge that photos and videos may be taken of my dog for social and other media, marketing, instructional videos, promotional, and advertising purposes without notice, permission, payment, or remuneration to me. A Bark Away NJ shall own all such media.

Continuation of Training Agreement:
By enrolling my dog in A Bark Away NJ's training program, I acknowledge and agree that continued training is essential for maintaining and reinforcing the behaviors and skills learned during the program. Training is a lifelong commitment and not a one-time solution. As the dog's owner, I am responsible for incorporating regular training sessions into my dog's daily routine to ensure consistency and long-term success. This includes dedicating time and effort to practice and reinforce the training techniques at home. My ongoing participation is crucial for the well-being and development of my dog.

Payment Agreement:
I agree to pay for the services provided by A Bark Away NJ according to the rates and schedule outlined in the service agreement. I understand that payment is due upon receipt of the invoice and that late payments may incur additional fees. If payment is not received within the specified time frame, A Bark Away NJ reserves the right to suspend or terminate services until payment is made in full. I acknowledge that I am responsible for any costs associated with the collection of unpaid balances, including legal fees if applicable.

Training Course Liability:
Participants in any training courses understand and acknowledge that dog training inherently involves certain risks, including but not limited to physical injury, property damage, and behavioral changes in dogs. By participating in these courses, participants voluntarily assume all risks associated with their participation. A Bark Away NJ, its instructors, employees, or affiliates are not liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the course, except in cases of gross negligence or willful misconduct.

Insurance Coverage:
A Bark Away NJ does not provide insurance coverage for any injuries or damages that may occur during the course. Participants are responsible for any medical care or veterinary expenses resulting from injuries or illnesses related to the training.

Release of Liability:
Participants hereby release, discharge, and waive any and all claims, demands, actions, or causes of action against A Bark Away NJ, its instructors, employees, and affiliates arising out of or in connection with the course, even in cases of negligence. Participants agree to indemnify and hold harmless A Bark Away NJ, its instructors, employees, and affiliates from any claims, losses, damages, liabilities, costs, or expenses arising out of the participant’s actions or omissions during the course.

Ongoing Efforts:
Participants acknowledge that the success of the training may require ongoing efforts beyond the course duration. A Bark Away NJ is not responsible for any changes in the dog’s behavior that may occur after the completion of the course.

Binding Agreement:
I acknowledge that this agreement constitutes a binding legal contract. By agreeing to these terms and conditions, I release certain legal rights. I have read, understood, and voluntarily agree to be bound by the terms outlined in this agreement.

Termination of Agreement:
A Bark Away NJ reserves the right to refuse service to any owner, customer, or client, at any time, for any or no reason.

Governing Law:
This Agreement is governed by the laws of the State of New Jersey and the State of New York without regard to conflicts of law principles. I agree and consent that all actions or proceedings arising directly, indirectly, or otherwise in connection with, out of, or related to training, the results of training, or from this Agreement shall be litigated only in courts located in New Jersey or New York. A Bark Away NJ and I waive trial by jury in any action, proceeding, or counterclaim arising under or in connection with this Agreement. If any provision of this Agreement is determined to be unenforceable, such provision will be deemed severed and the remaining provisions of this Agreement will continue in full force and effect. This Agreement may be signed electronically or in hard copy. If signed in hard copy, it must be returned to A Bark Away NJ for valid record. Electronic signatures are deemed wet signatures for all purposes. This Agreement shall be binding upon the respective successors, trustees, and assigns of the parties. If any provision of this Agreement is held to be unenforceable, it shall be adjusted rather than voided in order to achieve the intent of the Parties to the extent possible. The language of this Agreement shall be construed as a whole and not strictly for or against any party. This Agreement may be executed in one or more counterparts and may not be changed, modified, amended, or supplemented unless by a formal written instrument signed by the parties. No failure, delay, or partial enforcement by A Bark Away NJ in exercising any right or remedy shall operate as a waiver of that right or remedy.

 

By agreeing to these terms and conditions, I affirm that I have carefully reviewed, comprehended, and consented to the provisions outlined in this liability waiver.
